TERMS OF AGREEMENT
Upon payment, the customer accepts these terms and conditions. These terms and conditions apply to the sale, payment, delivery, pickup, claims, and returns of all products purchased on the webshop of Oud Beersel BV (shop.oudbeersel.com), hereinafter referred to as “Oud Beersel”, which shall be identified by the following information:

DEFINITIONS
“business days” are all calendar days except Saturdays, Sunday, and Belgian public holidays. (i.e. 5 business days = 1 typical week)
”the customer” is a person who uses shop.oudbeersel.com in matter to research products, order products, manage personal data on their account, or to manage past, current, or future orders.
GENERAL TERMS
When ordering from shop.oudbeersel.com, the customer explicitly accepts these general terms and conditions of sale which are published on this website. Acceptance of the general terms and conditions is mandatory in order to place an order, and the customer is prompted to accept these terms and Conditions. The current version of the general terms and conditions are always available and can be found on the website.
- All orders are bound by the applicable general terms and conditions, published at that moment on the website, to the exclusion of all possible prior or later conditions.
- In case one of these conditions should not be legally valid for any reason whatsoever, all other conditions still remain fully in force.
- Anything that is not explicitly mentioned in these terms and conditions of sale is bound by the regulations of Belgian and European law.
ORDER VALIDITY
Oud Beersel reserves the right to refuse any order that is:
- placed by a person who is not of legal age to purchase a given product
- placed by a person for delivery, transport, or export outside the territory of Belgium. Initially, the beers will only be available on the webshop for shipping in the EU. In the future, it is possible that Oud Beersel will make its webshop beer sales available in other countries. A customer from outside our area of delivery may arrange a courier pick-up upon agreement with Oud Beersel. In this case, the customer can contact Oud Beersel by sending a mail to shop@oudbeersel.com.
- placed for delivery to an address which Oud Beersel is not capable of shipping to
- placed for quantities equivalent to 10 boxes of beer and higher, or for quantities/deliveries not permitted by law
- placed with evident intent of off-premises resale. This webshop is intended for direct sales to private customers only.
PRICE VALIDITY
- The prices are shown on the website at the time of your order. All prices mentioned include 21% VAT, except books, to which 6% VAT is applied, and some food products to which 12% VAT is applied according to Belgian law.
- The prices of the product, the product offerings, and the webshop price structure may change. Oud Beersel reserves the right to change pricing as long as the customer is shown the actual price during shopping and checkout.
- An order that is placed, due to a human error or the manipulation of the system, for purchase at a price below an item’s cost price may be considered an inelligible order. If this happens, Oud Beersel may contact the customer to correct the price of their order or to cancel the order.
- The charges for domestic shipments are provided during the order process before finalizing the order. This means it is still possible to cancel the order at that stage. If the Customer’s delivery address does not correspond with Oud Beersel’s shipping price structure or shipping price zone, Oud Beersel may hold The Customer’s order until the Payment or Shipping Method is corrected.
- Additional costs like taxes and duties imposed by the customer’s country are at the charge of the buyer. The seller pays for excise taxes and VAT to the Belgian authorities.
PAYMENT CONDITIONS
- Payment must be prior to shipment or Pick-up Confirmation and is made using one of the payment facilities proposed during the check-out process.
- Payment by bank transfer is only possible according to specific exceptions, which must be confirmed in advance by Oud Beersel on a case-by-case basis. If a payment is made by bank transfer, the order is only executed upon receipt of the transferred amount. However, in the meantime the ordered item remains reserved for a period of 7 days, being the term within which the bank transfer must be executed and credited on the seller’s account, otherwise the order is cancelled.
- By paying for their order, the customer confirms that they are of legal age to purchase our products.
- Upon payment, the customer will receive a confirmation email with proof of purchase. If an invoice or receipt is processed manually, it will be provided within a reasonable timeframe.
PRODUCTS AND FULFILLMENT OF ORDERS
- OUD BEERSEL COMMITS TO PROCESS THE ORDERS PLACED ON THE WEBSITE AS LONG AS THERE IS STOCK AVAILABLE AND TO DO SO WITHIN THE RESTRICTIONS FORMULATED IN THESE CONDITIONS. THE ONLINE ORDER WILL BE PROCESSED ONLY IF THE CUSTOMER HAS CLEARLY IDENTIFIED THEMSELVES, WITH THE CORRECT PAYMENT, SHIPMENT, AND ORDER INFORMATION.
- THE SELLER RESERVES THE RIGHT TO REFUSE ORDERS IN CASE IT HAS STRONG SUSPICIONS OF ANY RIGHTS ABUSE OR SOMEONE ACTING IN BAD FAITH, IF THERE ARE STRONG SUSPICIONS OF COMMERCIAL PURPOSES UNACCEPTABLE TO THE SELLER OR IF THE STOCK OF A PARTICULAR ITEM IS EXHAUSTED.
- THE PRODUCTS ARE REPRESENTED ONLINE BY STANDARD PRODUCT IMAGES. IT IS POSSIBLE THAT THE ACTUAL PRODUCT VARIES SLIGHTLY IN PROPORTIONS, COLOR, OR PRINTING/LABEL DESIGN FROM THESE IMAGES. IT IS ALSO POSSIBLE THAT THE FLAVOR DESCRIPTION OF A PRODUCT DOES NOT PRECISELY MATCH THE PERCEPTION OF A CUSTOMER. PRODUCT DESCRIPTIONS ON OUR WEBSITE AND WEBSHOP ARE INTENDED TO GIVE A GENERAL IDEA OF WHAT TO EXPECT, AND ARE BASED ON THE SUBJECTIVE EXPERIENCE OF THE STAFF OF OUD BEERSEL.
- AN ORDER IS CONSIDERED FINAL ONLY AFTER PAYMENT FOR THE ORDER, ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS, ACCEPTANCE OF THE SHIPPING, PICKUP, RETURN, AND REFUND POLICY, ACCEPTANCE OF THE COOKIE POLICY, AND ACCEPTANCE OF THE USER PRIVACY POLICY. THE CURRENTLY VALID VERSION OF ALL POLICIES LISTED HERE CAN BE FOUND ON SHOP.OUDBEERSEL.COM.
RIGHT OF WITHDRAVAL
You have the right to withdraw from the contract within 14 days without giving any reason. During this period, you can do what is reasonably necessary with the product to assess the product. You are allowed to try the product as you would in a physical store. In addition, you can remove the product from the packaging, unless the packaging contains a seal. If you have done more than was necessary to try the product, we can charge you for it. Usage after the discovery of a defect, damage arising after the detection of a defect, encumbrance and / or resale after the detection of a defect, will invalidate this right of return.
For some items, it is not possible to return the item. This applies to items specially ordered for you, items with a shortened expiration date (the item then states that the item cannot be returned), as well as items where the seal (cork, crown cap, screw cap, bracket cap, etc.) is broken is. These items cannot be returned.
The withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, received the product. If you have ordered multiple goods with different delivery times in one order, expires the withdrawal period 14 days after the day on which you received the last product or part.
To exercise your right of withdrawal, we request that you send us an e-mail, whether or not including the model form, via shop@oudbeersel.com stating “Return”. You must submit the return products. Products returned without prior registration / return form will not be accepted. Always state your order number, name and address clearly visible. We request that you return the product as much as possible in the original packaging. Using this packaging reduces the risk of breakage.
The right of withdrawal is excluded for business customers.
REFUND
After you have made use of your right of withdrawal, you will receive all payments, including any delivery costs for the forwarding. We will refund you with the same payment method with which you paid, unless you agree with us on another method. Payment will be made after the return has been checked and found to be in good condition, within 14 days of receipt. You bear the costs for the return shipment. Returns are at the risk of the buyer. This means that Oud Beersel BV is not liable for damage or loss of returned items. Always ask for a shipping receipt and keep it well.

Any questions or complaints shall be submitted via email to shop@oudbeersel.com. Please understand that Oud Beersel is a small business, and will respond to all questions/complaints related to customers’ orders in due time.
CIRCUMSTANCES BEYOND OUR CONTROL
Should there be circumstances beyond the control of Oud Beersel that impact the customer’s order, Oud Beersel shall attempt to the best of its abilities to maintain its commitments stated in the terms of this agreement.
In the case of force majeure which makes it impossible for Oud Beersel to fulfill any of its commitments laid out in this agreement, all other conditions still remain fully in force.
LEGAL DISAGREEMENTS
This Agreement shall be construed under and governed by the laws of Belgium, and of the European Union, as applicable. Any disagreements arising out of or in connection with this Agreement shall be automatically settled upon deliberation of both Parties. In case of failure, the Parties irrevocably agree that the courts of Brussels / Belgium shall have jurisdiction to settle any dispute which may arise out of or in connection with this Agreement.
